As determined by the Breeder and the Breeder's veterinarian, the kitten named in this contract: __________, is in good health, and free from congenital defects and communicable diseases. The price for this kitten is $____, and includes a $500 non-refundable deposit to be paid upon reservation. Buyer and Breeder agree to the following terms:
A Breeder provides a three year limited genetic health guarantee. Should the kitten die as a result of a genetic illness as diagnosed by a licensed veterinarian through an official necropsy, the Breeder will provide a replacement kitten of like quality. Monetary refunds are not available. Shipping is excluded. Except as stated in this contract, the Breeder makes no representations as to the health of this kitten, nor does the Breeder assume any other financial obligations to the Buyer.
B Breeder provides an eight month guarantee against death from FIP (Feline Infectious Peritonitis). This only provides a guarantee against death following a diagnosis of FIP and not for a positive titer for the FeCOV or other Corona virus variants as these are common illnesses affecting 99% of all cats. Should the kitten die as a result of FIP before the age of eight months, a replacement kitten will be offered provided that the Breeder receives a necropsy report to determine the cause of death.
C Buyer may return the kitten to the Breeder for refund or replacement if, within the first seven days of possession, a licensed veterinarian certifies in writing that the kitten is ill or deformed in such a way as to make it unsuitable for the purpose for which it was intended. Any transportation costs, including a health certificate for airline travel, are the responsibility of the Buyer.
D Buyer agrees to have the kitten examined by a licensed veterinarian within seven days of possession.
E Breeder does not guarantee the hypo-allergenic quality of the kitten. Return of the kitten due to severe allergies for a refund can only be done after a minimum period of six weeks of allowing the allergic person to adjust to the kitten. The refund will be given after the kitten has been resold, and the refund will be in the amount for which the kitten has been resold.
F Buyer shall under no circumstances have the kitten declawed. Buyer understands that declawing is amputation, and may result in personality and physical changes in the kitten and will void any guarantees provided by this contract.
G Buyer agrees to spay or neuter the kitten at Buyer's expense between six months and one year of age. Failure to comply will void any guarantees provided by this contract.
H Administering the FIP or Leukemia vaccination at any time, or multiple vaccinations given at the same time, voids all health guarantees in this contract. See Cornell Study: Feline Vaccines: Benefits and Risks. See also: Vaccines for Cats .
I Buyer agrees to provide premium quality food and water, prompt veterinary care, and sanitary living conditions throughout the life of the kitten.
J Buyer shall not allow the kitten outside unless on a leash or in a secure enclosure.
K Buyer agrees not to sell, place or transfer ownership of the kitten without consulting and obtaining in writing Breeder's agreement. Failure to comply will void this contract.
L If Buyer is unable or unwilling to keep the kitten for any reason, the Breeder shall be contacted immediately. Breeder may reclaim the kitten at no cost (shipping excluded) and/or may assist Buyer in finding the kitten a mutually agreeable new home. Failure to comply will void this contract.
M Buyer will be liable to the Breeder for $5000 USD per kitten if the kitten named in this contract or any of it's progeny are used in a commercial breeding program known to be a kitten mill, sold to a pet shop or pet broker, or placed into an animal shelter, or breed or pet rescue.
N If the kitten is euthanized without Breeder's knowledge and consent, no monetary refunds or replacement will be available. Breeder must be informed if the kitten is in such condition that euthanization is considered.
O Buyer agrees to provide Breeder the opportunity to request a necropsy, at Breeder's own expense, should the kitten die of undetermined cause prior to the age of five years. This is to rule out possible genetic illness and allow the Breeder to take appropriate actions should a genetic cause be found.
